This is the Last Will and Testament of me, John Hetherington, Senior, of the Township of Scarborough in the City of York and Province of Canada, Yeoman, as follows, that is to say, First I will and direct that all my just debts, funeral and testamentary expenses, be paid by my executors hereinafter named as soon as conveniently may be after my decease and as to my worldly Estate, wherewith it hath pleased God to bless me, I give and dispose of the same as follows, I give and bequeath to my son, Thomas Alexander Hetherington, the north part of Lot number two, in the Fourth Concession ot the Township of Scarborough, of aforesaid containing seventy-five acres be the same more or less and I also give to my son Thomas Alexander Hetherington the South west corner of the said Lot number two containing twenty-five acres making twith the above named Seventy five acres at the north and of the North and of the said Lot number two, one Hundred acres, more or less, which said last mentioned piece of land shall be forty rod in length along the northern limit of the Forth (sic) Concession Line or road allowance and running one Hundred rods north on the western limit of the said Lot, to hold the said pieces or parcels of Lands to my said Son, Thomas Alexander Hetherington, his heirs and assigns, for ever, but my will is tha my Son, the said Thomas Alexander Hetherington shall support and provide all things necessary for my wife to make her comfortable during the continuance of the term granted to John Coxworth, being about five years from the date of this my will and that at the end of which this my will is that my said Son, Thomas Alexander Hetherington, his executors, administrators or assigns shall pay my said wife annually from thenceforth the sum of Fifty Dollars for her own use, in case she shall continue my widow and also that he shall give to her, my said wife, one cow for her use and a few poultry, together with the use of a part of the garden also, one comfortable room and sufficient furniture and firewood during her widowhood. And my will is that my two sons, John Hetherington and Thomas Alexander Hetherington shall receive the rent of my farm leased to John Coxworth during the term thereof granted to him in equal shares and proportion or share and share alike.
And whereas, I have due to me for Services, in the Terrone (sic) Regiment of Militia a Grant of Land from the Crown and utensils to settle on the same My will is therefore that in case the same can be obtained by my executors hereinafter named and I hereby give and devise the same to my three sons, William Hetherington, John Hetherington, and Thomas Alexander Hetherington, all and singular my Farming stock, farming utensils, household furniture and all other of my personal estate and effects (subject neverthe less to the payment of my just debts, funeral and testamentary expenses and the bequest hereinbefore made to my said wife) equally between them share and share alike. And Lastly, I nominate, constitute and appoint my threee sons, William Hetherington, John Hetherington and Thomas Alexander Hetherington, said executors of this my will hereby resolving all former wills by me at any time heretofore made and declaring this to be and contain my last will and testament in witness whereof I have hereunto set my hand and seal this eleventh day of February in the year of our Lord, one Thousand eight and fifty one.
